Is this corruption in Luxembourg?

According to heritage.org: Luxembourg anti-corruption laws are enforced effectively, and the society’s minimum tolerance for corruption encourages transparency and clean government.” The score they gave Luxembourg is 83/100.

Is it really so?

Former headmaster of European school 2 Paul Schiltz hired law firm Schiltz & Schiltz for representing European school Luxembourg 2 (and they still work for the school) – is this coincident or corruption?

First Schiltz in the name – Jean-Lois – is very important person in CSV. He was Minister for Defense in Lux Government (2004-2009), General Secretary of the CSV (2000-2006) and President of the CSV in the Chamber of Deputies 2009-present (Since the Second World War, every Prime Minister of Luxembourg has been a member of the CSV, with only one exception) and second Schiltz – Franz who is lecturing at training courses for future lawyers organized by the Ministry of Justice.

 

Who are the members of the Chambre de recours?

Our discrimination case has been set down for hearing at the Chambre de Recours in Brussels on Monday 12 November.

The Complaints Board is composed of persons whose independence is beyond doubt and who are recognised as being competent in law. Only persons on a list compiled by the Court of Justice of the European Communities are eligible for membership of the Complaints Board. It is composed of six members, appointed for a period of five years.

The current members of the Complaints Board are:

  1. Chairman : Mr Henri Chavrier, Honorary President of the Bordeaux Administrative Court (France),
  2. Section Chairman : Mr Eduardo Menéndez Rexach, Magistrate, Head of Cabinet, Presidency of the Judicial power’s General Council (Spain),
  3. Mrs Evangelia Koutoupa-Rengakou, Professor of Administrative Law, Faculty of Law of the University of Thessaloniki (Greece),
  4. Mr Andreas Kalogeropoulos, former judge at the Court of First Instance of the European Communities and former Chairman of the Appeals Committee of the European Investment Bank (Greece),
  5. Mr Mario Eylert, judge at the Bundesarbeitsgericht (Federal Labour Court) (Germany),
  6. Mr Paul Rietjens, Director-General of Legal Affairs and Legal Adviser – Federal Department of Foreign Affairs (Belgium).

It should be remembered that the Complaints Board is composed of six members who, being involved in activities in different Member States, are not assigned to it exclusively and that its registry is staffed only by a part-time registrar and a legal assistant.

Till now most of the cases were about appeals lodged against decisions to refuse pupils’ enrolment application, appeals lodged against non-promotion, appeals concerning the Regulations for Members of the Seconded Staff, appeals, concerning the European Baccalaureate, appeals lodged against decisions of the Board of Governors.

M. Dennis indique clairement qu’ils n’ont pas l’intention de modifier le plan de transport pour l’instant.

A ma connaissance, l’accueil à la BEI ne pose aucun problème et fonctionne à la satisfaction de tous les utilisateurs. Donc, je ne vois pas l’utilité de déplacer l’arrêt vers l’autre côté de la rue un mois seulement après l’ouverture de l’école à Mamer.

nous comprenons donc le dernier mail de Ian Dennis, ci de suite, dans le sens que les organisateurs des transports scolaires (APEEE et ATSEE) se déclarent disponibles à reconsiderer la possibilité de prevoir un arrêt à la Cour de justice, si l’administration des bâtiments:

offre des conditions de sécurité adéquates (contrôle d’accès, salle d’attente, gardien/surveillant, etc.)…
autorise l’arrêt formellement et au préalable.

Est-ce que la proposition du parvis de la Cour, dument complétée (par les autres conditions de sécurité) pourrait etre relancee officiellement par le CdP à notre administration des batiments, afin de pouvoir ensuite permettre auxdits aux organisateurs de la reconsidérer ?

L’accès au parvis n’est pas le seul élément de la mise en œuvre d’un système d’accueil à la CJE. Au moment de la conception du réseau des navettes du matin avant les congés d’été, la CJE n’offrait pas l’ensemble des éléments et nous avons donc choisi la BEI pour couvrir cette partie de Kirchberg. Nous ne prévoyons pas de changer cela pour l’instant.
C’était notre proposition au début, et il reste notre souhait, mais pour organiser les endroits d’arrêt à certains bâtiments des institutions pour les voyages de retour à la fin de la journée scolaire (13h30, 16h30, 18h10) nous exigeons des conditions de sécurité adéquates pour assurer de tels transferts, similaires à ceux offerts à l’école Lux.1 (contrôle d’accès, salle d’attente, gardien/surveillant, etc.)… et il faut que les administrations des bâtiments l’autorisent avant de pouvoir le considérer.

Si la Cour est d’accord ne pourraient pas les navettes s’arrêter au parvis de la Cour même au retour vers l’EE1?

Bonjour Marilena,

Lors de la réunion du Collège des chefs d’administration au Luxembourg du mois de juin, il était convenu que chaque institution propose un lieu de stationnement sécurisé pour les navettes de ramassage. Toutes les propositions ont été transmises à M. de Tournemire.

Il n’y a pas de memorandum, mais la Cour a proposé le parvis du Palais. Or, la proposition, qui a été retenue pour le plan de mobilité, établi par M. de Tournemire, est celle de la BEI.

Important transport problems – European school Mamer

Dear Mrs Laatu,

As you kindly asked me the last time we met, I would like to inform you that my children have been late all the days of this week, especially two days they were very late because they arrived at 9 o’clock.
Their teachers made very unpleasant comments and in my point of view, completely unjustified because it was a question of school transport and not my children’s fault.
This morning, I decided to drive them to school as my daughter has an important test in mathematics and she was deeply nervous about the prospect of being late.
It is not possible for me or my husband to go to school every morning. I have noticed that further changes for line 77 are also being considered and I hope that a solution will be found.

May I suggest to you to split the bus line into two parts: one for Bonnevoie and the other for Howald instead of having two buses going the same way?
I was very angry when I realized this morning that there were only two children on the bus for Kirchberg. My children are French and I would like to remind you that the Administration of the school decided to put them in the new school in Mamer when they were only in maternel and primary ten years ago.
We fought against the vertical split but we did not succeed. Finally, we have accepted and respected the rules based on geographic criteria to move to Mamer: we live in Howald in the south of Luxembourg and our children were sent automatically to the Mamer school.
Sometimes I wonder how is it possible to explain that French people who live in Bridel or Strassen have their children in the Kirchberg school on the principle of geographic criteria? But never mind…
Now the question of fairness is that the administration of the school promised to offer a convenient school transport system as the lucky french parents living in Bridel, Strassen have for their kids.

As I said openly in different meetings, I do not agree with the opinion that we cannot modify the Kirchberg budget concerning buses. I insist on reminding you that there are priorities to respect and Mamer school’s students have no choice: they need a school transport which is secure and punctual because it is absolutely impossible for their parents to bring them to school.

To conclude, I would add that I have experienced the train but the platform is full of young students and teenagers who are much too numerous for this small place and always pushing.
Please, take into account that it is dangerous and that something should be done urgently before there is an accident. You can also test the train just to consider the situation…

I am confident in the new school and I know that the arrivals/departures of the buses at/from the school in Mamer are secured and controlled. I am grateful for all what you have done and continue to do regarding the teachers’ team and organisation in general. I hope we can find for our children a balanced solution regarding punctuality, time spent during transport and fatigue.
If not that will be the best proof that there are different treatments compared to Kirchberg.

Central and Eastern European Film Festival in the European School Luxembourg II – Mamer
